Techdirt: Patent Office Rejects Blackboard E-Learning Patent One Month After It Wins Lawsuit

You may or may not know, but Blackboard has not been playing nicely with others in the sandbox. In recent news, Blackboard won a legal lawsuit against Desire2Learn (D2L) based on patents submitted--but not yet approved--to the USPTO patent office.

Now, Blackboard's patent has been reviewed and the Patent Office rejected said patent.

Where does this leave D2L and everyone else who may be developing, design, or creating e-learning software? In a sandbox filled with one castle defended by overly eager lawyers ready to sue anyone who tries to build a competing castle. I think it's safe to say that at this point, Blackboard is hoping to defeat their competition by collecting all the sand and using it to bury them under legal fees and time expenditures.
